These Terms of Service (the 'Terms') govern your use of our app Toxity and the services provided through it (the 'Services'). By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the App.

 

 

 

 

 

 

 

1. Agreement Between User and Developer

 

 

This agreement is between you, the end-user, and Cervello Labs, the developer of Toxity. Apple Inc. is not a party to this agreement and has no obligations with respect to the App or its content. This agreement does not provide you with any rights other than those granted under this license agreement.

 

 

 

 

 

 

 

2. License Scope

 

 

Cervello Labs grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on Apple devices that you own or control and as permitted by the App Store Terms of Service. This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

 

 

 

 

 

 

 

3. Our Services

 

 

Our App provides an AI analysis of a list of ingredients on a product. We aim to provide a helpful service, but we cannot guarantee the accuracy of our analysis. You understand that our analysis is based on the AI's interpretation of the data and may not always be correct. We are not liable for any consequences resulting from your reliance on our analysis.

 

 

 

 

 

 

 

4. Maintenance and Support

 

 

Cervello Labs is solely responsible for providing maintenance and support services for the App. Apple has no obligation to furnish any maintenance and support services with respect to the App. You can contact Cervello Labs for support at info@cervellolabs.com.

 

 

 

 

 

 

 

5. Your Use of the App

 

 

You agree to use the App only for its intended purpose and in accordance with these Terms. You will not use the App for any illegal or harmful activities, including, but not limited to, harming others, infringing on anyone's rights, or violating any applicable laws or regulations.

 

 

 

 

 

 

 

6. Intellectual Property Rights

 

 

The App and its content, including our AI analysis, are owned by Cervello Labs and are protected by intellectual property laws. You do not have any rights to our intellectual property except as explicitly granted by these Terms. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Cervello Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

 

 

 

 

 

 

 

7. Product Claims

 

 

Cervello Labs, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

 

 

 

 

 

 

 

8. Legal Compliance

 

 

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with all applicable third-party terms of agreement when using the App.

 

 

 

 

 

 

 

9. Limitation of Liability

 

 

Cervello Labs is not liable for any damages or losses resulting from your use of the App or our Services. This includes, but is not limited to, any damages or losses caused by our AI analysis being incorrect or incomplete, or by any failure of the App or Services to perform as expected. In no event will our liability exceed the amount you paid to use the App, if any.

 

 

 

 

 

 

 

10. Warranties

 

 

You understand that the App and Services are provided on an 'as is' and 'as available' basis, without warranties of any kind, express or implied. Cervello Labs does not warrant that the App or Services will meet your requirements, or that they will be uninterrupted, timely, secure, or error-free. To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the App.

 

 

 

 

 

 

 

11. Third-Party Beneficiary

 

 

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

 

 

 

 

 

 

 

12. Indemnification

 

 

You agree to indemnify and hold Cervello Labs, its affiliates, officers, and employees harmless from any claims, damages, or expenses (including legal fees) arising from your use of the App or Services, including any third-party claims alleging that your use of the App or Services infringes on their intellectual property rights or violates any applicable laws or regulations.

 

 

 

 

 

 

 

13. Governing Law and Jurisdiction

 

 

These Terms will be governed by and construed in accordance with the laws of the European Union. Any disputes arising out of or related to these Terms will be resolved through binding arbitration in accordance with the rules of the European Union.

 

 

 

 

 

 

 

14. Changes to these Terms

 

 

We reserve the right to modify or update these Terms at any time without notice. Your continued use of the App or Services will constitute your agreement to the updated Terms.

 

 

 

 

 

 

 

15. Termination

 

 

We may terminate your access to the App or Services at any time, without notice, for any reason. Upon termination, you must cease all use of the App and Services.

 

 

 

 

 

 

 

16. Entire Agreement

 

 

These Terms constitute the entire agreement between you and Cervello Labs regarding your use of the App and Services. They supersede all prior or contemporaneous agreements, whether written or oral, between us.

 

 

 

 

 

 

 

17. Waiver

 

 

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

 

 

 

 

 

 

 

18. Severability
